Acceptable Use Policy
This Acceptable Use Policy (the “AUP”) sets out a list of activities that are prohibited in connection with your use of any products or services (the "Services”) provided by Parallels International GmbH if you are obtaining a license to use software and documentation that is branded "Parallels", or Corel Corporation if you are obtaining a license for all other software and documentation (individually and collectively, “We” or “Us”) and the websites or portals associated with the Services (the "Services Site"). The examples described in this AUP are not exhaustive. We may modify this AUP at any time by posting a revised version. By using the Services or accessing the Services Site, you agree to the latest version of this AUP.
If your access to the Services is provided to you by an entity or individual other than Us (“Service Provider”), your use of the Services will also be subject to the agreement between Us and such Service Provider, which may be updated from time to time. In the event of any questions or concerns with this AUP or the Services, you should contact the Service Provider, and not Us, and any disputes you may have regarding your use of the Services must be handled via the Service Provider.
Any terms not defined in this AUP shall have the meaning as set forth in the terms which apply to the applicable Services.
General Prohibited Activities
While using the Services, you may not, at any time:
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the object code, source code, or underlying ideas or algorithms of the Services, the Services Site, or any License Keys you have obtained;
- Modify, translate, adapt, or create derivative works of the Services, Documentation, the Services Site or any License Keys that you have obtained in any way (except to the extent applicable laws specifically prohibit such restriction for interoperability purposes, in which case you agree to first contact Us and provide Us an opportunity to create such changes as are needed for interoperability purposes);
- Rent, lease, distribute, sell, resell, assign, or otherwise transfer the Services, the Services Site, or any copy thereof (except as otherwise permitted by Us in writing);
- Use the Services for timesharing purposes or otherwise for the benefit of any other person or entity;
- Remove any proprietary notices from the Services, the Services Site, or the Documentation or attempt to defeat any copy protection mechanism included with the Services;
- Use the Services or the Services Site for any purpose other than its intended purpose;
- Use the Services or the Services Site to attempt to gain or gain unauthorized access to any software as a service offering, cloud computing platform or any service provided by Us or our related systems or networks;
- Use the Services for any illicit or prohibited purposes or as a means to infringe any third-party rights;
- Upload to the Services any data, file, software, or link that contains or redirects to a virus, Trojan horse, worm, or other harmful component or a technology that unlawfully accesses or downloads content or information stored within the Services, the Services Site, or on the hardware of Us or any third party; or
- Access the Services or the Services Site to build a similar or competitive product or service or copy any ideas, features, functions, or graphics of the Services or the Services Site.
No Illegal, Harmful, or Offensive Use or Content
You may not a) use, or encourage, promote, facilitate, or instruct others to use the Services or Services Site and/or b) transmit, store, display, distribute, or otherwise make available content that is illegal, harmful, fraudulent, infringing, or offensive. Prohibited activities or content include:
- Illegal, Harmful or Fraudulent Activities. Any activities that are illegal, that violate the rights of others, or that may be harmful to others, our operations or reputation, including disseminating, promoting or facilitating child pornography, offering or disseminating fraudulent goods, services, schemes, promotions, or phishing.
- Infringing Content. Content that infringes or misappropriates the intellectual property or proprietary rights of others.
- Offensive Content. Content that is defamatory, obscene, abusive, invasive of privacy, promotes or glorifies hatred, violence, racial or religious intolerance, or organizations which promote such views, or is otherwise defamatory; is pornographic, obscene or similarly adult-oriented; depicts or promotes illegal activity; is excessively or gratuitously violent; is highly disturbing to an appreciable number of viewers; is unlawful, harmful, harassing, or threatening; displays confidential information without proper authority;
- Harmful Content. Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.
- Illegal Export. Exporting software, technical information, encryption software or technology, in violation of international or regional export control laws.
- Data Privacy Misuse. Using any Personal Information or Personal Data in violation of and as defined by applicable privacy laws and regulations.
No Security Violations
You may not use the Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a “System”). Prohibited activities include:
- Unauthorized Access. Accessing or using any System without permission, including attempting to probe, scan, or test the vulnerability of a System or to breach any security or authentication measures used by a System.
- Falsification of Origin. Forging e-mail headers, or any part of a message describing its origin or route. The legitimate use of aliases and anonymous remailers is not prohibited by this provision.
- Distribution of Account. Revealing your account password to others or allowing use of your account by others, or otherwise circumventing user authentication or security of any host, network or account.
No Network Abuse
You may not make network connections to any users, hosts, or networks unless you have permission to communicate with them. Prohibited activities include:
- Intentional Interference. Interfering with the proper functioning of any System, including any deliberate attempt to overload a system.
- Avoiding System Restrictions. Using manual or electronic means to avoid any use limitations placed on a System, such as access and storage restrictions.
No E-Mail or Other Message Abuse
You will not distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising, or solicitations, including commercial advertising and informational announcements via the Services or Services Site.
Monitoring and Enforcement
We reserve the right, but do not assume the obligation, to investigate any violation of this AUP or misuse of the Services or Services Site. We may investigate violations of this AUP or misuse of the Services or Services Site and remove, disable access to, or modify any content or resource that violates this AUP or any other agreement we have with you for use of the Services or the Services Site. Our determination of whether a violation of this AUP has occurred will be final and binding, and any action taken with respect to enforcing this AUP, including taking no action at all, will be at our sole discretion.
We may report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Our reporting may include lawfully required disclosure of Customer and/or End Client information.
Reporting of Violations of this AUP
If you, or any of your Authorized Users, become aware of any violation by you or any of your Authorized Users of this AUP, you will immediately notify Us and provide Us with assistance, as requested, to stop or remedy the violation.
